US Prosecutors Seek 12-Year Sentence for Terraform Founder Do Kwon in Crypto Fraud Case

US federal prosecutors are pushing for a 12-year prison sentence for Terraform Labs founder Do Kwon, marking one of the most significant criminal prosecutions in the history of the digital asset industry.

The request, submitted in a sentencing memo this week, follows Kwon’s conviction on multiple fraud-related charges tied to the catastrophic collapse of TerraUSD (UST) and LUNA in 2022, an event that erased more than $40 billion in market value and destabilized the broader crypto ecosystem.

Prosecutors Argue Kwon Misled Investors and Concealed Critical Risks

In their filing, prosecutors accused Kwon of orchestrating a scheme that deliberately misled investors about the stability and backing of TerraUSD, an algorithmic stablecoin that ultimately spiraled into a death loop. They allege Kwon repeatedly concealed structural vulnerabilities within the Terra ecosystem while promoting the token as a reliable, dollar-pegged asset.

Collapse of UST and LUNA Still Reverberates Across the Industry

The algorithmic design, relying on arbitrage mechanisms with sister token LUNA, broke under market stress, leading to a cascading collapse and wiping out billions in investor capital. Do Kwon, who was arrested in Montenegro in 2023 for traveling with falsified documents, is being sought by both the United States and South Korea. Each country has filed criminal charges tied to investor deception and violations of financial laws.

While Kwon has denied wrongdoing throughout the proceedings, both US and South Korean authorities claim that Terraform Labs manipulated trading activity and misrepresented the sustainability of UST’s peg.
